This Privacy Policy aims to give you information on how we collect and process your personal information through any form of your engagement with us. This Privacy Policy complies with, and facilitates the obligations required from, the South African Protection of Personal Information Act, No. 4 of 2013 ("POPIA"), as amended.

We do not process the data of minors nor special categories of personal information. Do not provide us with any such personal data, as it will constitute an immediate and automatic material breach of this Privacy Policy and our Terms.

TerraCapture complies with Google Play’s User Data Policy and all applicable developer requirements regarding data collection, usage, and disclosure.

What We Collect About You

We will only process personal information under one or more lawful bases — your express consent, to perform on a services contract, for our legitimate business interests, or to comply with a legal obligation. We use your information to:

• Register, create, and maintain your account on the App;
• Enable geological data collection, mapping, sampling, and drilling management;
• Support team collaboration and sharing of project data among authorised users;
• Process payments, manage subscriptions, and administer billing;
• Detect, prevent, and address fraud or security breaches;
• Send service-related communications and, where permitted, marketing materials;
• Improve our App and services through data analytics.

Data Security & Retention

We have put in place appropriate security measures including third-party encrypted data transfer and secure access-controlled database storage. We limit access to your personal information to those with a legitimate need to know.

We retain personal information only as long as necessary to fulfil the purpose it was collected for. Upon account deletion, User Data is permanently deleted within 30 days unless retention is required by law.

Your Legal Rights

You have the right to request access, correction, erasure, restriction of processing, transfer, or to withdraw consent regarding your personal information. Contact us at admin@terra-capture.com to exercise these rights. We will respond within one month.

You also have the right to make a complaint to the Information Regulator’s Office of South Africa.

Cookies

The Platform may use cookies to collect information and improve functionality. If you do not want information collected using cookies, you can disable them in your browser settings, though this may limit access to certain features.

International Transfers

We may process your personal information outside of South Africa for cloud storage or third-party service providers. We ensure appropriate safeguards are in place in accordance with POPIA requirements.

By accessing or using our website https://www.terra-capture.com ("the Platform"), or our application TerraCapture ("App") or any of our services, you agree that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

Please pay specific attention to the bold paragraphs of these Terms. These paragraphs limit our risk or liability, constitute an assumption of risk or liability by you, impose an obligation on you to indemnify us, or are an acknowledgement of a fact by you.

Our Services

TerraCapture is a comprehensive geological data collection and management platform designed for mineral exploration projects. The App offers tools to map exploration sites, record and manage sampling and drilling data, and utilise customisable forms. TerraCapture supports offline logging and features team collaboration capabilities for seamless data sharing and synchronisation.

Subject to your compliance with these Terms, TerraCapture grants you a personal, revocable, non-exclusive, non-transferable license to access and use the TerraCapture software solely for your internal business purposes.

Registering with TerraCapture

To use the Services, you must register and open an account through the App. You agree to provide accurate, current, and complete information and to update it as required. By sharing personal data with us, you warrant that the persons using the Services have the authority to do so. Please see our Privacy Policy for details on how we use and process personal data.

Responsibilities and Warranties

By using the App and Services, you warrant that you:

• Have read and agreed to these Terms;
• Are above 18 years of age and have the legal capacity to be bound by these Terms;
• Will not post or transmit abusive, threatening, defamatory, or discriminatory content;
• Will not interfere with the operation or functionality of the App or Services;
• Will not infringe the intellectual property or other rights of any third party or TerraCapture;
• Will not use the App for any purpose other than as expressly provided for herein;
• Will not use the App to breach any applicable law or regulation.

Confidentiality

You acknowledge that the processes, functionality, and services of the App constitute our valuable proprietary and confidential information. You agree to maintain the confidentiality of all such information and not to disclose, reproduce, or use any part of our processes or App functionality for any purpose other than as expressly permitted under these Terms.

Intellectual Property

All content, materials, data, software, designs, trademarks, and underlying code on the Platform are owned or licensed by TerraCapture and are protected by applicable laws. You retain all rights to intellectual property you provide, but grant us a revocable, non-exclusive license to use it as needed to deliver our Services.

You may not use, copy, modify, or distribute any intellectual property or code without our prior written consent. Breach may result in legal action.

Indemnities and Disclaimers

The App and Services are provided on an "as is" and "as available" basis without any warranties of any kind. We do not warrant that the App will meet your specific requirements or that any defects will be corrected. Your use of the App is at your sole risk.

To the maximum extent permitted by applicable law, TerraCapture, its shareholders, directors, employees, partners, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App or Services.

You agree to indemnify and hold harmless TerraCapture, its shareholders, directors, employees, and partners from any demand, action, claim, liability, loss, or expense arising out of or in connection with your use of the App or Services, or your breach of these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY MAY BE HELD LIABLE UNDER THESE TERMS FOR ANY AMOUNT EXCEEDING THE AMOUNT PAID BY A CLIENT TO TERRACAPTURE FOR ITS SERVICES DURING THE PRECEDING TWELVE MONTHS.

Dispute Resolution

Should any dispute arise, the parties will first endeavour to resolve it amicably by negotiation, then mediation, and if still unresolved, by binding arbitration in terms of the expedited rules of the Arbitration Foundation of Southern Africa ("AFSA"). Both parties consent to the jurisdiction of an appropriate South African court.

Termination

We reserve the right to restrict and/or terminate your use of our App or Services if you breach any of these Terms, or for any other reason in our sole discretion, provided that we give reasonable notice to you.

You may delete your account via the App’s settings or by submitting a deletion request to admin@terra-capture.com. All deletion requests will be processed within 30 days after identity verification.
